Southington police have arrested an Avon man that they said caused a serious accident in May leaving Ellen Tomczak in serious condition, the department revealed Monday.

Officers took David G. Fay, 36, into custody late last week on charges including operating a motor vehicle while under the influence of alcohol and evading responsibility in an accident. He was released after posting bond and is due in Bristol Superior Court for arraignment on Aug. 19, court officials said.
Sgt. Jeffrey Dobratz said Monday that Fay was taken into custody following an investigation into an accident that occurred on May 24 in front of the Southington Fire Department Headquarters on North Main Street in Southington.

Fay had been driving a 2005 Honda Accord north along Route 10 following a trip to the bars when police said he “failed to negotiate the roadway” and collided head-on with Tomczak, a Southington resident, as she was traveling south around the turn.

“After the collision, Fay fled the scene on foot and returned to the scene over an hour after the collision,” Dobratz said. “After returning to the scene, Fay was transported to the hospital for treatment.”

Tomczak suffered what police have called “serious physical injuries” and continues to recover from the injuries suffered in the accident.
