Police Rule Pedestrian At Fault in West Avon Road-Country Club Road Accident

Police cited the Avon teenager with reckless use of a highway.

Police cited an Avon teenager with "reckless use of a highway by a pedestrian" after an accident involving the pedestrian and a driver turning left off of West Avon Road onto Country Club Road more than a week ago.

The pedestrian, whose name police redacted from the police report because he is under 17, told police that he thought he had enough time to cross Country Club Road that afternoon despite seeing the driver making the turn and the "red crosswalk signal," according to the accident report provided by police. 

The accident happened on April 26 at 2:35 p.m.

The teenage boy was crossing Country Club Road, heading away from Avon Middle School, when he "made contact" with the 2004 Toyota Nicholas Zacchio, 17, of Avon, was driving, police said. Zacchio told police that had just turned left from West Avon Road onto Country Club after stopping at the traffic light when a pedestrian "came running out into the roadway from his right." He was "unable to stop before contact was made," Zacchio told police, as detailed in the police report.

Witnesses to the accident said they saw the pedestrian run into the crosswalk at the time of the accident, police indicated in the accident report. One witness confirmed that she saw a "no walk signal" at that moment, according to the report.

American Medical Response, Avon police and the Avon Volunteer Fire Department responded. The ambulance took the pedestrian to Connecticut Children's Medical Center to be treated for injuries and he has since been released from the hospital.

The Toyota sustained "no visible damage" in the accident, police said. The car was registered to Zacchio's father, Mark Wayne Zacchio, who is Avon's Town Council chairman.
