Government Shutdown Impacts Employers

We are a few days into the federal government shutdown and during this time, operations of many businesses have been largely impacted. Employers must take note of the parts of the government that have been suspended which are significant to their business.

Access to E-Verify Accounts Suspended

  • Denied access to these accounts will prevent participating employers from using it to verify employment eligibility. 
  • Tentative Non-confirmations will not be resolved during this time. 
**The three-day requirement for completing Form I-9 is not affected and is still in place during the shutdown**

Equal Employment Opportunity Commission
  • Activity related to charge processing, mediation and outreach is suspended.. 
  • Time limits, with regard to charges, will still run during the shutdown. 
  • Claims may still be submitted via the EEOC’s online-based system, though no actions will be taken to process submitted charges or cases until the government reopens. 
  • Federal Sector hearing requests, appeals and requests for reconsideration will be accepted during the shutdown, but any actual hearings will be postponed. 
  • Deadlines for discovery and submitting motions, briefs and complaint file contents will be extended respective to the number of days the government is shut down.

National Labor Relations Board
  • All hearings and representation elections have been postponed. 
  • Where extensions are allowed, deadlines for filing documents (including briefs and appeals) will be automatically extended respective to the number of days the federal government is closed. 
  • In instances where extensions are not permitted (such as for certain statutes of limitation), the NLRB intends to construe the phrase, “Saturday, Sunday or a legal holiday” in its rules pertaining to filing and service to include any day on which the NLRB offices are closed due to the government shutdown.


Department of Labor
Offices and Agencies completely closed
  • The Administrative Review Board
  • The Office of Federal Contract Compliance Programs
  • The Veterans Employment and Training Administration 

Offices with most services suspended:
  • The Occupational Safety and Health Administration (OSHA)
  • The Wage and Hour Division 
  • The Office of Labor Management Standards
